B. Adoption of Resolution No. 12-3358, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF VENTURA TO CONSOLIDATE A FILLMORE MUNICIPAL ELECTION OF SAID CITY TO BE HELD ON NOVEMBER 6, 2012, WITH THE PRESIDENTIAL GENERAL ELECTION TO BE HELD ON SAID DATE PURSUANT TO SECTION 23302; AND AUTHORIZING THE BOARD OF SUPERVISORS TO UTILIZE CRITERIA SET FORTH IN ELECTIONS CODE SECTION 15651(A) AND RESOLVE THE TIE VOTE BY LOT.
C. Adoption of Resolution No. 12-3354, FIXING THE COMPENSATION OF EXEMPT NON-REPRESENTED MANAGEMENT/MIDMANAGEMENT STAFF, PART-TIME EMPLOYEES OF THE CITY OF FILLMORE AND SUMMARIZING AGREEMENTS CONCERNING BENEFITS AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT FOR THE PERIOD JULY 1, 2012, TO JUNE 30, 2014, OR UNTIL ALTERED AND AUTHORIZE THE CITY MANAGER TO MAKE ANY CHANGES AS NECESSARY TO ACHIEVE THE INTENT OF THE CITY COUNCIL.
D. Adoption of Resolution No. 12-3355, ESTABLISHING THE WAGES, HOURS AND TERMS AND OTHER CONDITIONS OF EMPLOYMENT FOR EMPLOYEES REPRESENTED BY THE INTERNATIONAL UNION OF OPERATING ENGINEERS LOCAL NO. 501 THROUGH JUNE 30, 2014.
E. Consideration and Adoption of City Council RESOLUTION NO. 12-3339: SETTING THE APPROPRIATIONS LIMIT FOR FISCAL YEAR 2013.
8. Public Hearings
A. Consideration and Adoption of Resolution No. 12-3340 Adopting the Recommended Budget for Fiscal Year 2013 and Authorizing the City Manager to Make and Necessary Changes to Achieve the Intent of the City Council.
Recommendation: 1) Adopt Resolution No. 12-3340, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FILLMORE, ADOPTING THE FISCAL YEAR 2012-2013 OPERATING BUDGET and authorize the City Manager to make any necessary changes to achieve the intent of the City Council.
B. Schedule of Fees and Charges for City Services and Adoption of City Council Resolution No. 12-3357 Schedule of Fees and Charges for City Services
Recommendation: 1) Open the public hearing and obtain public comments; and
2) After receiving public comments, close the public hearing; and
3) Adopt City Council Resolution NO. 12-3357 SCHEDULE OF FEES AND CHARGES FOR CITY SERVICES.
C. Consideration of Rates, Direction to Staff and Adoption of Utility Fees (Water and Wastewater) Contained in the Recommended Budget for Fiscal Year 2012-2013 and Authorize the City Manager to Make any Necessary Changes to Achieve the Intent of the City Council.
Recommendation: 1) Adopt Water rates as presented in the Recommended Budget (an increase of four percent (4%) to $35.81 per month for the average user on January 1, 2013; which equated to an increase of $1.38 per month for the average user; and,
2) Adopt Wastewater fee increases of three percent (3%) which uses $1 million of the Rate Stabilization Fund and $203,028 of the deferred revenue to offset the seven percent (7%) planned increase in the budget; or,
3) Direct staff to increase Wastewater rates by a different amount and direct the City Manager to make any necessary changes to achieve the intent of the Council.
D. Consideration of Adoption of Resolution No. 12-3352 Confirming the Annual Budget and ordering the Levy and Collection of Assessments for the Fillmore Storm Drain Maintenance Districts in FY 2012/2013
Recommendation: 1). Open the Public Hearing to received public testimony regarding the City Council’s intent to confirm the annual budget and ordering the levy and collection of assessments; and
2) Close the Public Hearing; and
3) Adopt RESOLUTION NO. 12-3352 CONFIRMING THE ANNUAL BUDGET AND ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS FOR THE FILLMORE STORM DRAIN MAINTENANCE ASSESSMENT DISTRICTS NOS. 01, 01A, 03, 04, 05, 06, AND 07 IN FISCAL YEAR 2012/2013, PURSUANT TO THE BENEFIT ASSESSMENT ACT OF 1982.
E. Consideration and Adoption of Resolutions Approving the Engineer’s Annual levy Report for FY 2012/2013 and Ordering the levy and Collection of assessments within the City of Fillmore Landscape and Lighting District No. 2 and Heritage Valley Landscape and Lighting District 2007-1.
Recommendation: 1) Open the Public Hearing to Receive Testimony Regarding City Council’s intent to Approve the Annual Reports and Levy of Assessments; and
2) Close the Public Hearing; and
3) Adopt RESOLUTION NO. 12-3348 APPROVING THE ENGINEER’S ANNUAL LEVY REPORT FOR THE CITY OF FILLMORE LIGHTING AND LANDSCAPE MAINTENANCE DISTRICT NO 2 FOR FISCAL YEAR 2012/2013; and
4) Adopt RESOLUTION NO. 12-3349 ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN THE CITY OF FILLMORE LANDSCAPE AND LIGHTING MAINTENANCE DISTRICT NO. 2 FOR FISCAL YEAR 2012/2013; and
5) Adopt RESOLUTION NO. 12-3350 APPROVING THE ENGINEER’S ANNUAL LEVY REPORT FOR THE CITY OF FILLMORE HERITAGE VALLEY LIGHTING AND LANDSCAPE DISTRICT 2007-1 FOR FISCAL YEAR 2012/2013; and
6) Adopt RESOLUTION NO. 12-3351 ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS WITHIN THE CITY OF FILLMORE HERITAGE VALLEY LANDSCAPE AND LIGHTING DISTRICT 2007-1 FOR FISCAL YEAR 2012/2013.
