City Attorney
A. Request City Council to Approve Settlement Agreements
Recommendation: That the City Council approve the seven agreements
discussed herein, the: (1) Settlement Agreement with San Joaquin
County; (2) Joint Resolution and Agreement by County of San Joaquin
and City of Fillmore; (3) Settlement Agreement with City of Industry; (4)
Sales and Use Tax sharing Agreement with City of Industry; (5)
Settlement Agreement with City of Lathrop; (6) Settlement Agreement with
Livermore and (7) Clarification of Economic Development Agreement
Between City of Fillmore and MTS Consulting, LLC.

City Council
B. Request City Council to Appoint an Elected Official to the Board of
Directors of California Joint Powers Insurance Authority (CJPIA) as
Primary and any Council or Staff member as the alternate.
Recommendation: That the City Council appoint a primary and alternate
to the Board of Directors of CJPIA.
Community Services
C. One Time Only Grant monies in the amount of $22,855.00 for FY
2012/2013 for replacement of commercial kitchen equipment at the Multi-
Purpose Center (hood and exhaust, convection oven, refrigerator, and
freezer).
Recommendation: 1) That the City Council authorize the use of funds in
the amount of $22,322.62 to be taken out fo the Recreation, Senior
Nutrition Fund, Furniture and Equipment for the replacement of new
kitchen equipment for the Senior Nutrition Program at the Multi-Purpose
Center. These funds will be reimbursed back to the Recreation/Senior
Nutrition Fund within 30 days of submitting invoices and proof of payment
to the County; or 2) That the City Council deny the request for
authorization of funds in the amount of $22,322.62 for the replacement of
new kitchen equipment for the Senior Nutrition Program at the Multi-
Purpose Center.
D. Update on the Aquatic’s Facility MOU contract between the City of
Fillmore and the YMCA.
Finance
E. Continued Review of the FY 2013-14 Recommended Budget.
Recommendation: 1) Continue its review of the FY 2013-14
Recommended Budget and make any desired changes; and 2) Upon
Completion of its review and approval of any changes, adopt the attached
resolution approving the FY 2013-14 Approved Budget and Budget
Management Guidelines.
Municipal Services Department
F. Public Hearing on Placing Past Due City Utility Charges as an
Assessment on the FY 13/14 Tax Roll for Collection.
Recommendation:

a. Receive a presentation from City Staff;
b. Open the Public Hearing
c. Receive verbal and written testimony from any member of
the public with a past due account;
d. Close the Public Hearing;
e. Consider any testimony and written comments received;
f. Provide any direction to City staff deemed appropriate, this
could include (i) direction staff to continue researching
individual situations, responding to customer inquiries and
defer further Council consideration until August or (II)
adoption Resolution 13-3392, Approving the Levy of Past
Due Water; Sewer, and Source Reduction Charges as an
Assessment to be collected at the same time and in the
same manner as the City Property Taxes; and
g. Waive any penalty amounts for those past due accounts that
were paid in full by the close of the Public Hearing and direct
staff to make refunds of those penalties that were paid by
July 18 (six weeks after the June 6 Notice date).
G. Public Hearing to Consider the Adoption of Resolutions Approving the
Engineer’s Annual Levy Report for FY 2013/2014 and Ordering the Levy
and Collection of Assessments within the City of Fillmore Landscape and
Lighting District No. 2 and Heritage Valley Landscape and Lighting District
2007-1.
Recommendation: 1) Open a Public Hearing to receive public testimony
regarding City Council’s intent to approve the annual reports and levy of
assessments; 2) Close the Public Hearing; 3) Adopt Resolution 13-3387,
Approving the Engineer’s annual Levy Report for the City of Fillmore
Lighting and Landscape maintenance District No. 2 for Fiscal Year
2013/2014; 4) Adopt Resolution 13-3388, Confirming the Diagram and
Assessment and Ordering the Levy and Collection of Assessments within
the City of Fillmore Landscape and Lighting Maintenance District No. 2 for
Fiscal Year 2013/2014; 5) Adopt Resolution 13-3389, Approving the
Engineer’s Annual Levy Report for the City of Fillmore Heritage Valley
Lighting and Landscape District 2007-1 for Fiscal Year 2013/2014; and 6)
Adopt Resolution 13-3390, Confirming the Diagram and Assessment and
Ordering the Levy and Collection of Assessments within the City of
Fillmore Heritage Valley Landscape and Lighting District 2007-1 for Fiscal
Year 2013/2014.
H. Public Hearing to Consider the Adoption of Resolution 13-3391 Confirming
the Annual Budget and Ordering the Levy and Collection of Assessments
for the Fillmore Storm Drain Maintenance Districts in FY 2013/2014.

Recommendation: Recommendation: 1) Open a Public Hearing to
receive public testimony regarding City Council’s intent to confirm the
annual budget and ordering the levy and collection of assessments; 2)
Close the Public Hearing; 3) Adopt Resolution 13-3391 Confirming the
Annual Budget and Ordering the Collection of Assessment for the Fillmore
Storm Drain Maintenance Assessment Districts Nos. 01, 01A, 03, 04, 05,
06 and 07 in Fiscal Year 2013/2014, pursuant to the Benefit Assessment
Act of 1982.

A. CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION
The City Council will conduct a closed session, pursuant to Government
Code Section 54956.9(d)(1) to confer with legal counsel regarding
litigation to which the City is a party. The title of such litigation is as
follows: CalFuel, BOE Case No. 486732; Aramark, BOE Case No.
466375; Southwest Jet Fuel BOE Case No. 486732; Twin Med, BOE
Case No.468761, Walgreen, BOE Case No. 469672; Owens & Minor,
BOE Case No. 626418; Hawaiian Gifts, BOE Case No.468869 and City of
Livermore and City of Industry v. City of Fillmore, Los Angeles County
Superior Court Case No. BC411865.
13.Adjournment: Mayor Neal adjourns this meeting to the next Regular Council
