Dear Freedom Center Supporter, The Individual Rights Foundation (IRF) - the Freedom Center's powerful legal arm - is taking part in what will undoubtedly be one of this nation's landmark court cases regarding discrimination. The IRF is serving as a friend of the court in the now-famous case, Frank Ricci, et al. v. John DeStefano, et al. ... or as it is sometimes referred to, the New Haven Firefighters case. If you are not familiar with the case, I will tell you, sadly, it is as blatant a case of discrimination on the basis of color as you will currently find in our nation. And smack in the middle of this outrage is Judge Sonia Sotomayor - Barack Obama's ultra-liberal nominee for the Supreme Court. But before I give you a brief synopsis, I have to ask for your help. Because it is effective, the IRF is taking on more and more worthwhile cases - solely or in action with other groups. To help ensure we have the strongest team and best legal advice, research and presentation possible for this case, as well the other cases we have in play, the IRF needs to raise $18,500 as soon as possible. Frank Ricci grew up poor in a blue-collar Connecticut town. Public schools weren't prepared to help with the learning disabilities Ricci has, so he was a C to D student. From high school he joined the New Haven fire department. When he started a family of his own, he began working two jobs. When he had a chance for a promotion he quit his second job, spent $1,000 on books and, because he has severe dyslexia, he hired someone to read him the material. To his credit, Frank scored sixth on the lieutenant's exam. His life was due to change. More income for his family, more challenge and respect from his job. His was another amazing American success story. Enter Judge Sotomayor. In a short, unsigned 134-word opinion, she supported New Haven's city government's decision to throw out the test results. New Haven officials claimed they faced discrimination suits because minority members taking the exam hadn't qualified for promotion. The exam was "race neutral" - designed to give all takers the same opportunity to advance. But basically because the majority who qualified for promotion were white, the City of New Haven trashed the results. Judge Sotomayor agreed. Just imagine how her race-based decision hurt Ricci's life. Imagine how it hurt the others who had worked hard, studied hard and passed the test. The IRF is now in the fight to reverse the Sotomayor decision. We need your help right now!
