Governor Arnold Schwarzenegger announced today that he has signed a package of bills to improve patient privacy laws and to address repeated breaches of confidential information that have occurred at health facilities in recent months. “Medical privacy is a fundamental right and a critical component of quality medical care,” Governor Schwarzenegger said. ”Repeated violations of patient confidentiality are potentially harmful to Californians, which is why financial penalties are needed to ensure employees and facilities do not breach confidential medical information. Californians seeking care at a hospital or health facility should never have to worry that their private medical information will be shared.” Patients’ legal right to confidential medical services in health facilities is strongly recognized and clearly defined in both state and federal law. However, under current law it is difficult to impose and enforce penalties when breaches occur unless a district attorney or the state Attorney General takes action. The bills signed by Governor Schwarzenegger give the state tools to assess and enforce fines against health facilities and individuals who inappropriately obtain, use or disclose medical information. SB 541 by Senator Elaine Alquist (D-Santa Clara) sets health facility fines for privacy breaches and increases the fines for serious medical errors in hospitals. The new law ensures that health care providers face real consequences when they fail to protect patients. For facilities, fines for disclosing private medical information would range from $25,000 to $250,000 per reported event. The California Department of Public Health (CDPH) would assess an administrative penalty of $25,000 per patient whose medical information was breached and a penalty of $17,500 per subsequent breach. If several individuals access the same patient’s file, for example, the penalty would be $25,000 plus $17,500 for each additional person who violated the same file, up to a maximum of $250,000. Californians will benefit from accessible nutritional information at thousands of restaurants
Governor Arnold Schwarzenegger today signed SB 1420 by Senator Alex Padilla (D-Pacoima), which makes California the first state in the nation to have its restaurant chains with 20 or more locations statewide post calorie information on menus and indoor menu boards for consumers. “This legislation will help Californians make more informed, healthier choices by making calorie information easily accessible at thousands of restaurants throughout our state,” Governor Schwarzenegger said. “By being the first state to provide this information to consumers, California is continuing to lead the nation with programs and policies that promote health and nutrition.” SB 1420 requires restaurant chains with 20 or more locations to post calorie information on their menus and indoor menu boards by January 1, 2011. And beginning July 1, 2009, brochures containing either calorie content information or other nutritional information, such as grams of saturated fat, grams of carbohydrates and milligrams of sodium, will be at the point of sale and drive-thrus for consumers. The legislation preempts local ordinances in order to create a uniform statewide standard for displaying nutritional information instead of a patchwork of local ordinances, although nothing in the bill would prevent a restaurant from providing additional information if they so choose. The Governor also signed SB 441 by Tom Torlakson (D-Antioch), which requires each vendor who operates or maintains a vending machine on state property to satisfy the requirement that at least 35 percent of the food and at least one-third of the beverages offered in the vending machines meet accepted nutritional guidelines by January 1, 2011. The Governor’s leadership has put in place some of the nation’s most innovative and successful strategies to promote health and nutrition. The Governor has: Established the toughest school nutrition reforms in the nation, taking junk food and sugary sodas off our campuses. According to the California Department of Public Health, Californians have gained 360 million pounds over the last decade. One in three children and one in four teens are overweight or at-risk. Second only to tobacco, obesity is a leading cause of preventable death among Californians and costs the state $28.5 billion in health care costs, lost productivity and workers’ compensation. |

The League of Women Voters invites the public to a candidates’ forum for Hannah-Beth Jackson and Tony Strickland, candidates for the State Senate District 19. The forum is co-hosted by The League of Women Voters, Calif. Lutheran University and the Ventura Mobilehome Residents Council (VMRC). The League of Women Voters is a non-partisan organization that encourages informed and active participation in government. This State Senate race is the most contentious race in California this election cycle and this forum will be an opportunity for the public to ask their questions of the candidates. California reached another environmental milestone today with Governor Arnold Schwarzenegger’s signing of AB 1879 by Assemblymember Mike Feuer (D-Los Angeles) and SB 509 by Senator Joe Simitian (D-Palo Alto), moving our state on the path toward a comprehensive green chemistry program to reduce or eliminate hazardous chemicals in our products and the environment. “This bi-partisan package of environmental legislation propels California to the forefront of the nation and the world with the most comprehensive Green Chemistry program ever established,” Governor Schwarzenegger said. “It also puts an end to the less effective ‘chemical-by-chemical’ bans of the past. With these two bills, we will stop looking at toxics as an inevitable bi-product of industrial production. Instead they will be something that can be removed from every product in the design stage—protecting people’s health and our environment. I am excited to lead this effort, which will spur a new era of research and innovation and promises to drive economic growth and competition in the green chemistry sector.” A bi-partisan effort, AB 1879, is jointly authored by Assemblymembers Feuer and Jared Huffman (D-San Rafael) and co-authored by Assemblymembers Sam Blakeslee (R-San Luis Obispo), Ed Hernandez (D-West Covina), Jose Solorio (D-Anaheim) and Senators Simitian and Ron Calderon (D-Montebello). SB 509 by Simitian was co-authored by Assemblymember Feuer and Senator Ron Calderon. AB 1879 establishes authority for the Department of Toxic Substances Control (DTSC) to develop regulations that create a process for identifying and prioritizing chemicals of concern and to create methods for analyzing alternatives to existing hazardous chemicals. It also allows DTSC to take certain actions following an assessment that range from “no action” to “restrictions or bans.” The bill also establishes a Green Ribbon Science Panel made up of experts to provide advice on scientific matters, chemical policy recommendations and implementation strategies, as well as ensuring implementation efforts are based on a strong scientific foundation. Moreover, it expands the role of the Environmental Policy Council, made up of the heads of all California Environmental Protection Agency boards and departments, to oversee critical activities related to the implementation of the green chemistry program. Largest Individual Project Allocation to Date Brings Prop 1B Funding Allocation to $4.8 Billion Statewide
Governor Arnold Schwarzenegger today announced the allocation of $730 million Proposition 1B funding to build 10 miles of a High Occupancy Vehicle (HOV) lane on Interstate 405 in Los Angeles (between Interstate 10 and Highway 101). This is the largest individual Proposition 1B project allocation made to date, and was part of more than $800 million in Proposition 1B funding allocated today by the California Transportation Commission (CTC). “When California voters approved Proposition 1B they wanted action, and we are delivering that action,” said Governor Schwarzenegger. “This funding will not only help relieve the traffic congestion that clogs our Los Angeles freeways – it will create jobs and help stimulate California’s economy when we need it the most.” $810 million in Proposition 1B funding was allocated today by the CTC. This includes $80 million for HOV lanes in El Dorado County and Sonoma County, and funding for traffic and safety improvements through the bond's Traffic Light Synchronization Program and the State Transportation Improvement Program. The CTC also allocated $69 million from other funding sources for 29 other transportation projects. Since the passage of Proposition 1B, $4.8 billion has been allocated by the CTC and other state agencies. This week the Governor signed the 2008-09 budget, releasing the $227 million in Proposition 1B funds previously allocated by the CTC in July and August 2008. Governor Arnold Schwarzenegger today signed the 2008-09 state budget, concluding a very difficult budget year and delivering a real win for Californians with a proposal to achieve meaningful budget reform. It addresses California’s $15.2 billion budget shortfall with a combination of cuts and increased revenues. It fully funds education’s Proposition 98 guarantee and does not borrow funding from voter-approved local government or transportation funds. The historic budget reform package includes a strong rainy-day fund aimed at helping smooth out the unpredictable highs and lows in revenues that plague our state and create massive deficits. “While California is certain to face a difficult budget situation again next year, this budget does not take money out of people’s paychecks or borrow from voter-approved local government or transportation funds, and it includes real budget reform with teeth,” Governor Schwarzenegger said. “These budget reforms, when approved by voters, will finally put California’s budget on a path toward long-term fiscal stability.” Throughout California’s history, numerous attempts have been made to reform our state’s broken budget system. When the Governor was elected, he committed to finally end California’s feast and famine budget cycle. In 2004, the Governor worked with the legislature to pass Proposition 58, which took the first step toward budget reform. In 2005, the Governor attempted the next step in budget reform with Proposition 76, and while it was defeated, the Governor remained committed to reform. Today, the Governor delivered on his commitment with reforms to address two major flaws in the state budget system—wildly volatile revenues and over spending. In fact, had these reforms been in place over the past decade, this year’s budget problem would have been approximately $10 billion smaller and California would have benefited from $8 billion in additional funding available for infrastructure and other one-time purposes.
