Forty years after the U.S. Supreme Court attempted to settle the abortion debate once and for all, anxious activists on both sides of the homosexual-marriage debate are waiting with bated breath for high court rulings some hope will settle the future of marriage. The history of abortion law and politics, though, illustrates compellingly that judge-made solutions to vast questions of social policy are doomed to failure. If the Supreme Court is paying close attention to what its rulings in Roe v. Wade and Doe v. Bolton (1973), and Casey v. Planned Parenthood (1992) have done to its authority and prestige, it will take a pass on trying to remake the meaning of marriage.

Consider just how unsettled abortion law remains in the United States. Justice Harry Blackmun and his six majority colleagues attempted to craft a decision that, from conception to birth, made the mother of an unborn child the arbiter over whether that child lives or dies. Overnight, the laws of 50 states — conservative, moderate and liberal — were swept away in favor of a legal regime previously unknown to the planet’s legal traditions. The lack of constitutional foundation for the court’s profoundly legislative ruling — the creation of a “trimester” scheme of increasing regulation, but no prohibition — was immediately noted by scholars left, right and center.

QUETTA, Pakistan -- Militants in western Pakistan bombed a bus carrying women university students on Saturday and then seized part of the hospital where survivors of the attack were taken, killing at least 12 people, officials said.

This surveillance scandal arises out of our national bipartisan unwillingness to face the reality of Islamic jihad. Because we all agree that Islam is a religion of peace, we can't possibly address where the threat is really coming from, and monitor mosques or subject Muslims with Islamic supremacist ties to greater surveillance. Instead, we have to pretend that anyone and everyone is a potential terrorist, and surveil everyone. Our freedoms and privacy are now at risk because of our refusal to admit the truth about Islam.

People who leak classified information need to be punished, but Snowden is more of a whistleblower, akin to a Soviet dissident working against an all-encompassing government. It is good that it came out that they're watching our every move, reading all our emails, etc. It needed to come out because it needs to stop if we are going to have any chance of surviving as a free people and not becoming a totalitarian state in which every slave of the authoritarian rulers is under constant surveillance.

Despite the flaws in the technology, the obvious ways that criminals will circumvent the technology, and the difficulties crime labs will have in deciphering the marks, on May 17, 2013, California Attorney General Kamala Harris certified that microstamping is available to firearm manufacturers.

With this simple announcement, new and safer state-of-the-art pistol models essential for home and family defense became impossible for Californians to acquire, because to be sold in California all new semi-automatic pistol models must now have microstamping incorporated into their design in order to be approved for sale in California.

Over at Fox News today (via RaymondIbrahim.com), I discuss how Islam's "number theory" works -- that is, the more Muslims, the more Islamic phenomena, in this case, brutal violence against non-Muslims:

Last week in London, two Muslim men shouting jihad’s ancient war-cry, “Allahu Akbar” beheaded a British soldier with a cleaver—in a busy intersection and in broad daylight. They boasted in front of passersby and asked to be videotaped.

As surreal as this event may seem, Islamic beheadings are not uncommon in the West, including the U.S. In 2011, a Pakistani-American who helped develop “Bridges TV”—a station “designed to counter negative stereotypes of Muslims”—beheaded his wife. In Germany in 2012, another Muslim man beheaded his wife in front of their six children—again while hollering “Allahu Akbar.”

In the version of the video containing remarks from the jihad murderer in London today that can be found above, he clearly mentions Surat at-Tawba at the beginning. (Thanks to Kenneth.)

Why has this video been edited to remove his references to the Qur'an?

He says, "Surat at-Tawba through...many, many ayat throughout the Qur'an that...we must fight them as they fight us..."

Surat at-Tawba is the ninth chapter of the Qur'an, and according to Islamic scholars is the last one or one of the last ones to have been revealed that contain doctrinal content -- which means that it takes precedence over the others. Some highlights:

"And when the sacred months have passed, then kill the polytheists wherever you find them and capture them and besiege them and sit in wait for them at every place of ambush. But if they should repent, establish prayer, and give zakah, let them [go] on their way. Indeed, Allah is Forgiving and Merciful." -- 9:5

"Fight them; Allah will punish them by your hands and will disgrace them and give you victory over them and satisfy the breasts of a believing people and remove the fury in the believers' hearts. And Allah turns in forgiveness to whom He wills; and Allah is Knowing and Wise." -- 9:14-15

"Fight those who do not believe in Allah or in the Last Day and who do not consider unlawful what Allah and His Messenger have made unlawful and who do not adopt the religion of truth from those who were given the Scripture - [fight] until they give the jizyah willingly while they are humbled." -- 9:29

Last Friday, an Afghan journalist named Mustafa Kazemi posted on Facebook a harrowing story about an eight-year-old girl in the Khashrood district of Nimruz province in Afghanistan, who was sold off into marriage to a mullah in his late 50s, and who bled to death on their wedding night.
It was one of many such tragedies in a land that little notes nor long remembers such deaths. An eight-year-old girl sold into marriage and dead after a brutal sexual assault that her body could not withstand is no more noteworthy than a pack animal that collapses under a too-heavy weight. It’s time and money wasted, that’s all. Forget about it. Get another one.

Experts can’t always predict exactly how public policy will affect the nation, despite our best efforts. But when it comes to immigration policy, we have tried many of the types of reforms advocated by today’s Gang of Eight—so we should consider the effects these reforms had in the past.

In the mid-’80s, many Members of Congress advocated amnesty for long-settled illegal immigrants. President Reagan considered it reasonable to adjust the status of what was then a relatively small population, and as his attorney general, I supported his decision.

The path to citizenship was not automatic. Immigrants had to pay application fees, learn to speak English, understand American civics, pass a medical exam, and register for military selective service. Those with convictions for a felony or three misdemeanors were ineligible.

This should sound familiar, as it’s quite close to the path and provisions set forth by the Gang of Eight.

Today they call it a “roadmap to citizenship.” Ronald Reagan called it “amnesty.” And he was right.

The 1986 reform did not solve our immigration problem—in fact, the population of illegal immigrants has nearly quadrupled since that “comprehensive” bill.

When it comes to tracking crime guns, California is immune to scientific infection.

Knowledge should precede policy. Yet California gun policy is often made in engineered ignorance. Despite pleas from law enforcement and assistance from the National Rifle Association, California’s most basic crime gun research processes wouldn’t receive a passing grade for a Research Methodologies 101 class.

The good news is Congress cares about trying to fix our flawed immigration system and broken borders.

The bad news is they want to do it with a solution that looks a lot like Obamacare—the “Gang of Eight” 844-page-plus “comprehensive” bill.

The sad news is that such an “easy button” solution will not improve our immigration system.

History shows that big bills designed to solve everything wind up creating as many problems as they address. They become loaded with payoffs for special interests and often introduce measures that work at cross purposes.

The “comprehensive” bill fails at the start. Here are the top five reasons it cannot be fixed.

1. Amnesty. This bill grants amnesty. It creates a framework for legalization for the estimated 11 million people unlawfully present in the United States. Anyone who was present in the U.S. before 2012 qualifies, but there is too much opportunity for fraud—since there is no proof required that applicants have been here for several years.

In 2010, the Obama Administration banned the term "Islamic Extremism" from the central document outlining American national security strategy. This decision may explain why the F.B.I. failed to monitor the Boston bomber, even after receiving a tip that he was radicalized. In the aftermath of the Sandy Hook Elementary School tragedy, America’s gun control movement was momentarily reenergized. Many reasoned voices sought solutions for such events, which unimpassioned analysis showed to mainly be a mental health issue. Gun control groups also concurred on the mental health aspect, then squandered that brief moment of collaboration by tossing their dusty legislative wish list into the political maelstrom. Knowing that their more extreme measures had little or no chance of passage – such as Dianne Feinstein’s now stalled “assault weapons” ban – they include seemingly benign and popular measures including “universal” background checks.

As with assault weapons, the public self-educated on the topic, and is now rejecting the plan. And for good reasons.
